What should I do before applying for a home-based recruitment VISA?

What are the reasons for the refusal to issue a household recruitment VISA?
- Financial ability does not permit the issuance of a VISA.
- Based on the “Household Recruitment Controls“, the measurement of financial capacity is linked to two main factors: the first factor is the number of VISAs issued and active at the client when the application is raised. The second factor is the number of domestic workers currently in the client. The minimum salary or statement of account varies depending on the visa number to be issued.
- The attached documents are incomplete.
- Based on the “Household Recruitment Controls“, attach all pages of the following documents: Account Statement or Salary Identification Certificate. The names in these documents must match the name of the applicant.
- The attached documents are unclear.
- The attached documents must be clear so that all the required data are clearly shown.
- The number of issued visas exceeded the limit
- Based on the “Household Recruitment Controls“, there is a higher limit of visas by category (issued, currently active and intended to be issued) and allowed to the applicant.
- The application can not be completed due to traffic violations on the applicant.
- The applicant must pay for all traffic violations.
- The application can not be completed for non-payment of visa issuance fees
- Applicant must pay the fees for issuing a visa for domestic workers (2000 SR)
- One of the attached documents does not have the same name as the applicant
- The names in the documents must match the name of the applicant.

- A bank certificate is required. And the date of the certificate shall not exceed 3 months from the date of filing the application

- Non-Saudi family is required to recruit by proving a definition of salary only
- Based on the “Household Recruitment Controls“; the non-Saudi family can prove their financial ability by means of a salary identification certificate.
- The signature of the applicant and the stamp on the salary definition must be present
- The applicant must sign and stamp the salary. (Salary, date of employment for private sector not less than 3 months)
- Applicant’s social status does not permit the issuance of a visa for the required occupation
- In accordance with the “Household Recruitment Controls“; recruitment is available to individuals in accordance with the nature of the applicant’s social status.
- If the applicant is single or single, he must be at least 25 years old
- According to the “Household Recruitment Controls“; the applicant must be single or single to be at least 25 years of age.

What is the work that can be assigned to a domestic worker?
The employer must comply accordingly:
- The domestic service worker shall not be required to perform any work other than that agreed upon in the contract, or to work with third parties, except in cases of necessity, provided that the work to which he is assigned does not differ materially from his original work.
- The domestic worker shall not be required to carry out any hazardous work or damage that threatens his life, his health, or his human dignity.
- Not to hire the domestic worker, or to be allowed to work for his own account.
What is the work that should a domestic worker do?
The domestic worker must comply accordingly:
- Follow the orders of the employer and his family members regarding the implementation and performance of the agreed work, and take care of the usual person.
- Not refusing to work or leave the service without a legitimate reason.
- Not working for his own benefit.
Can the employer terminate the contract during the trial period without any liability?
What are the steps taken when the contract ends with the death of one of the parties?
What are the steps in case the contract is terminated or canceled for an illegal reason?
What are the steps taken when a domestic worker is absent?
When the domestic worker leaves the work, the employer must inform the nearest police station, to comply accordingly:
- Inform the Passport Department of the escape of the domestic service worker to take the necessary action.
- Inform the Labor Office, to ensure that the domestic worker does not have a claim against the employer, or the employer has a claim against the domestic worker. When there is an action, the Labor Office must inform the Passport Department.
- Provide the author with a copy of the escape notice.

What are the procedures for losing a domestic worker's passport?
The procedures if losing the passport of the domestic worker is as follows:
- A letter from the employer or his legal agent, signed and certified by the Chamber of Commerce and the pledging that the passport is not held or in the possession of any governmental department.
- Declaring the loss of the passport in a local newspaper.
- Copy of the lost passport if available.
- Attach a copy of the residence of the owner of the lost passport.
- Filling out the investigation form for the loss of the passport, reasons and reasons for losing it by the person who lost the passport and stamping it with the seal of the establishment or the signature of the employer.
What are the procedures for applying for a replacement residence permit?
The procedures for applying for a replacement residence permit is as follows:
- Inform the competent authority of passport department or police for the loss of residence permit.
- Bring a letter from the employer or the resident head of the family to the passport department, indicating the reasons for the loss of the residence permit and the place where it was lost.
- Bring the passport of the expatriate beneficiary of the residence “valid” with a copy of the lost residence permit, if any.
- Filling out the form for the loss of residence permit, at the Passport Department.
- Filling out the form for issuing the residence permit, matching the information stated in the passport, signing the form and stamping it with the stamp or employer signature.
- If the remaining period of residence is less than one year old, the one-year residence fee (SR 500) will be paid by SADAD.
- Bring (2 photos) colored, new and size (6×4)
- In case of non-communication within 24 hours, the fine for the loss of the residence permit (SR 1,000) shall be paid under Article 61 minimum.
- Fingerprint registration is required.

Rights and Duties
What is the employer's wage to pay, and when is it paid?
The employer must comply accordingly:
- The agreed wage shall be paid at the end of each Hijri month, unless otherwise agreed by the parties in writing.
- The wage and its dues shall be paid in cash or by cheque. This shall be documented in writing, unless the worker wishes to transfer it to a specific bank account.
Is it permissible to deduct from the wages of the domestic worker, and in any cases?
It is not permissible to deduct from the wages of the domestic worker except in the following cases and not exceeding half the wage:
- Costs of damages, intentionally or negligently.
- Advance payment received from the employer.
- The execution of a judgment or an administrative decision issued against him, unless stated in the judicial decision or administrative decision that the deduction exceeds half the wage.
When is the domestic worker entitled to end of service benefits?

What are the duties of a domestic worker towards home property?
What are the duties of a domestic worker towards the safety of the employer and his or her family?
The domestic worker must comply accordingly:
- Does not harm family members, including children and the elderly.
- Preserves the secrets of the employer, family members and persons in the house during work, and not to disclose it to others.
- Does not affect the dignity of the employer and his family members, and not interfere with them.
What is the penalty for violation by the employer?
Without disrupting other regulations, the employer who contravenes the provisions of these regulations shall be punished as follows:
- A fine of not more than (2000 Riyals), or to prevent him from recruitment for one year, or both.
- If the offense is repeated, he shall be punished with a fine of not less than (2000 SR), not exceeding (5000 Riyals), or by preventing him from recruitment for three years, or both.
- If the violation is repeated for the third time, the Committee may prevent the violator from recruitment permanently.
- The penalty shall be multiplied by the number of offenses established against the employer.
What is the penalty for violation by a domestic worker?
Without disrupting other regulations, the domestic worker who contravenes the provisions of these regulations shall be punished as follows:
- A fine of not more than (2000 Riyals), or prevent him from working in the Kingdom permanently, or both.
- The fines shall be multiplied by the number of irregularities fixed on the domestic worker.
Domestic workers shall afford the costs of return to their countries. If he or she did not have financial dues that would meet the fines, they would be deported to their countries at the expense of the Kingdom.
